Nintendo must use the Eternal Darkness trademark or lose it

Nintendo’s strength has always been developing family friendly games, and they recently admitted that the marketing focus for the 2013 festive period was children and their parents. This focus on a family audience may need to take a backseat for at least one project if Nintendo don’t wish to lose the trademark of one of their most popular GameCube era franchises.

Eternal Darkness was developed by former Nintendo second party developer Silicon Knights, and released on the GameCube after starting life as a Nintendo 64 title. Fans have long wanted there to be a follow up, but the prospect of this happening seemed unlikely after Nintendo and Silicon Knights parted ways after the release of Metal Gear Solid: The Twin Snakes.

Hopes were raised that a spiritual successor to the game titled Shadow Of The Eternals would come out after several of the original games developers tried to raise money for the project though crowd funding. The high target weren’t met and that project appears to be dead in the water.

A document from The United States Patent and Trademark Office has emerged which reveals that Nintendo have been given six months in which to file a statement of use of the Eternal Darkness trademark or risk losing it. They may file for extensions a total of five times, giving them a total of thirty six months to use the Eternal Darkness trademark or they will forfeit it.

With so few Wii U exclusives being targeted towards a mature audience a sequel would certainly be welcomed by many gamers. It is perhaps more likely that Nintendo may choose to release the game either as a HD remake or Virtual Console title as after ten plus years since the original game many of today’s gamers would need to be introduced to the series before buying a sequel.

        I never played it because I never had the GC, but everyone I know that had it said that game was really good. I have been hoping for a chance to play that game without having to borrow the GC or buy one…HD remake would be perfect!

          Exactly, me too. Never played it, would rather play the remake than just jump into a sequel. Though I suppose a sequel alongside releasing the original on the VC would suffice.

    Why are Reggie and Satoru coming up with different excuses for this game not being on Wii U yet? This is exactly why the Wii U message has confused consumers into buying PS4.

    I would lap up an HD Remake but much prefer a sequel. I don’t want my Wii U collection to be the same games as my gamecube collection.

    USE IT!!! This is one of my favorite GameCube games and I replay it every few years and probably always will. An amazing title that deserves a current-gen follow up.

      Each year I start a new playthrough, complete it once, start the next ‘god/ancient’, take a break and find it hard to get back into so I have to start from scratch but the whole concept never feels tired. Even the clunky combat (by today’s standards) feels refreshing compared to the 2 button approach of 90% of modern games.

        When you are descending the steps down into the city of the dead its just breathtaking. So many beautiful/cool moments in that game. I highly recommend picking up a copy to anyone with a cube or a backwards compatible Wii.

          I remember being secretly a little bit scared by how epic the last section of the game was. Words can’t really describe how good this game was. People bang on about the narrative of modern games being a huge step up from previous gens but this game is still one of the best stories in any game I’ve played.

            Wholeheartedly agree. It’s a very philosophical, deep game. The whole bit in the temple about the “dawn, noon, and dusk” of mankind. It’s almost eerie at times, and has given me the shivers when playing like no other game since OOT. It has stood the test of time, and if you play it with the Component Cable in 480p it looks fantastic to this day..

    The original flopped, ZombiU flopped. Survival horror games, with a few exceptions, rarely seem to do well. Some of the biggist cult classics in videogaming history like System shock 2 were survival horrors.

    I think Nintendo should supply a wide range of games, including survival horror games, but they’d rather spend money and resources on games which could potentially get a large audience… like a pokemon spinoff.

      I sometimes think they try to make certain games fail so they don’t get asked to make them again. I know they don’t want to make games that fail to sell but, like you say, they’d rather put more resources into hyping the next Mario, Pokemon or Wii series game.

    Hurry up and do it Nintendo! ED is a true horror game and is realy unique and so should stand out in today’s market (it’s not getting much competition form RE6)
    Not only would this bring back an overlooked Nintendo franchise but it would add great variety to a predominantly family-friendly library and would please all the mature gamers. Please, if EAD doesn’t want to do it then give it to Retro. Nintendo has enough talented teams out there to make this dream (or should I say sanity effect) a reality.

    Nintendo should buy Shadow Of The Eternals from the guys who were trying to make it, re-brand it as an Eternal Darkness game (which by all intents, it seems it basically was, anyway, minus the name) and release it as a Wii U exclusive retail title.

      Well it was rumoured that silicon knights was working on a sequel for wii u before they lost that court case and went bust. Then, as I understand it, former silicon knights employees tried to crowd source for the spiritual successor.

      If true Nintendo tried to do something with the series but it fell apart. Did they then hand it over to someone else to work with? IDK. But it would seem to make sense that they hand it over to this new company of old SK employees.

    Nintendo aim is not towards kids and family but towards making games for all people so games for wide audience actually for all audiences i have played games from nintendo that were “kiddy“ but extra hard no kid can finish them and i have played a lot of “mature“ gamesfrom nintendo so they were never focusing on one audience but to all audiences kidsand older people.

    back in the NES or SNES era dark and hardcore-ish games were very common also because there were so many more developers making games for nintendo. now mostly comes from nintendo itself but the indie scene is increasing with some good output. but looking at nintendo everything has to be super sweet, cute and also fairly easy.. games are not so hardcore as they used to

    Eternal Darkness: Sanity’s Requiem is the only game in the series that I know of but it is probably my joint favourite game of all time with RE4. It’s a horror game that plays a bit more like the older RE games but the main draw is the sanity effects. Your character has a health, sanity and magic meter and if your sanity gets too low you experience insanity.

    edit: I meant characters. The game revolves around many misfortunate individuals who are caught up in a huge supernatural conspiracy

    There’s sadly only 1 ED game (for now) and it’s really good! I don’t play a massive amount of horror games but ED is a lot like an old Resi game (actually tense and atmospheric unlike RE6). It plays a lot like Resi but with a lot more puzzle-solving as you go through the locations playing as several different characters throughout different periods history all connected to the main protagonist by a supernatural conspiracy. The game is also famed for trolling the character and even player with sanity effects – sometimes walls in the game will drip blood or books will fly of the shelves but sometimes a fake menu will come up on screen telling you your data has been deleted or even flies crawling over the TV screen.
    You should try it, it’s apparently quite rare so I don’t know how much it’ll cost but I don’t think it’s quite Earthbound rare

    Yeah it was quite a surprise when it came out. The game had sanity effects which really messed with your head. The original creators tried to kickstart a “spiritual successor” but it failed to meet its goal. Hopefully nintendo picks up the reigns and gets this made but whe it was a critical hit, it was never hugely profitable. I really think Njntendo needs a line of hardcore games. They’re fully capable of delivering great experiences for a more adult audience. They could maybe do what DC comics did with their vertigo line of adult comics.

    Melee was second to me and was my most played game ever I played that for 5 years. I still have my copy both American and European “germany”. I loved the game so much but Brawl was better but I had more fun on Melee.

    A stylish survival horror would be an ok fit for Nintendo. As long as it’s not gratuitous gore. I’ve said it before, but I don’t see why they don’t release a hd version of Fatal frame 4. It’s never seen a western release and like Eternal darkness it’s a survival horror they helped create. Could also be made to use the gamepad well.

    The game have some effects like up the tv volume, change channel and others things that i don’t remember.

    now they can do the same in real life with the IR from the controlpad, imagine that!.

    They could integrate TVii and pretend to delete your DVR recordings! The gamepad is a great fit. It would be good just to cast magic and to have as a real representation of ‘The Tome’

    I thought maybe they could use the camera and get a short video of your face during a certain section and then play it back to you later on either on a painting or tv screen in the game. The moment you realised that it was’t just the live feed from the camera would probably freak me out just like the old fake error messages.
